Small Claims Court

Is someone taking you to the Small Claims Court and you don’t know how to defend it?

In either case we can help you with our friendly and affordable advice.

Small Claims Court – Money Claims

If you need to solve a simple legal problem, for example:

  • You have a Faulty Product, or there has been a Poor Service
  • You are owed money
  • There has been a Breach of Contract
  • Building Disputes
  • Car Repair Problems

Small Claims or Money Claims are a specific part/process of the County Court and are meant for claims where the amount of money is less than £10,000 and the legal issues are simple.

Of course, “simple” in a legal context may not be that simple to understand. This is where we can help. We will have an initial telephone conference to see if your claim has merit and we will also discuss the possibility of recovering any award made by the Court, should you be successful in your claim.

We can help you to identify the person or company that you need to name as the defendant in your application.

We will help you to establish the law surrounding your claim and how it can be applied.

If you need to go to Court and appear before a Judge, we can help you to prepare for that appearance, or if you prefer, we can represent you at the Hearing[1].

Atheneys Law can provide you with as much or as little assistance as you need. We can prepare Pre-Action letters, prepare whole cases and assist you in Court. How we help you, is based on your needs and budget.

For Small Claims work we charge £100[2] per hour and we may be able to agree to a set fee for our work from the outset.

The Court encourages mediation. We have experience in successful mediation and can help you with this if it is right for you. In our experience, meaningful mediation is a positive and practical alternative to the Court process. It is often quicker, cheaper and less stressful than issuing a claim in the County Court.
